German AI market surveillance act implementing the EU AI Regulation enters into force

The Bundesnetzagentur becomes the central market surveillance authority for compliance with the EU AI Regulation in Germany. A coordination and competence centre is being set up there to pool AI expertise and support other authorities; at least one AI regulatory sandbox is also to be established for testing innovative AI systems. The act designates the competent national federal and state authorities for market surveillance and notification duties.

The act implementing the EU AI Regulation (AI Act of June 2024) entered into force on 30 July 2026 and creates the national enforcement framework. The federal government describes the approach as innovation-friendly and low in bureaucracy while protecting fundamental rights and strengthening trust in AI.
