- The Federal Network Agency (Bundesnetzagentur) issues its second partial decision BK10-25-0043 (served on 8 October 2025): from January 2026 DB InfraGO must announce planned construction works within the deadlines
At present 60% of construction notices are late on average, up to 100% in some regions; for continued breaches, coercive fines of up to €1 million are possible, and affected railway undertakings can object to the works and use their booked train path as planned, in which case penalty payments to them fall due.
In its second partial decision BK10-25-0043 (served on 8 October 2025), the Federal Network Agency requires DB InfraGO to announce planned construction works in good time from January 2026; at present this does not happen for 60% of construction notices on average, and for up to 100% in some regions. If breaches continue, coercive fines of up to €1 million are possible, and railway undertakings can object to the works concerned so that they can run their booked train path as planned, in which case penalty payments to them fall due. Short-notice, unplanned works are not covered; DIE GÜTERBAHNEN (managing director Peter Westenberger) welcome the decision as a signal against construction chaos. (LOK Report, 9 Oct 2025)
