Several member states have blocked the opening of Cluster 3 for Serbia since July and the camps in the Multiannual Financial Framework remain unreconciled, which meets the criterion of a core decision blocked for longer than one Council meeting; for "serious" there is no evidence of several core decisions blocked at once by vetoes, a declared refusal to implement a CJEU ruling, or an Article 7 procedure in the voting phase; the situation was only partly re-checked in this run and the previous snapshot remains authoritative.

No substantive change since the last run.
The EU has decided and implemented in enlargement: on 13 Oct 2026 Clusters 2 and 3 were opened for Ukraine and Moldova, and on 12 Oct Montenegro closed three more chapters (21 of 33 in total). Still open are the opening of Cluster 3 for Serbia (eight member states against, as of 8 July), the blockade of North Macedonia and the de facto standstill of Georgia; no new Council decision on these was found. On the Multiannual Financial Framework 2028-2034, Council President Costa is preparing bilateral talks with all delegations on new own resources, according to Eunews (21 Oct), and plans a new compromise proposal with the missing figures for the extraordinary summit at the end of November; own resources are seen as the key question, and an agreement only in 2027 remains possible. On the rule of law, restoration in Hungary continues (Commission proposal of 23 Sept to release EUR 4.2bn); a Council decision on it was again not found in this run, and according to search hits the funds are still not formally released. Infringement proceedings against Slovakia have been running since November 2025. Not reached: the official text of EUCO 14/26 and the outcome page of the General Affairs Council of 13 Oct (the latter returned HTTP 403, otherwise only search excerpts), the state of the Article 7 procedure, current Schengen controls (last confirmed: Slovenia notifies controls at the borders with Croatia and Hungary until 21 Dec 2026, from a search excerpt only). Addendum 27 Oct: according to Xinhua (14 Oct, source: Hungary's EU delegation), the Council ended the conditionality procedure against Hungary on 13 Oct and released the funds; this rests on that one report only. As of 29 Oct: the renewed search for a Council decision on releasing the EUR 4.2bn for Hungary found only reports on the Commission proposal of 23 Sept, which the Council has one month to confirm according to EUobserver; a second source for the decision of 13 Oct reported by Xinhua is still missing. Nothing dated after 27 Oct on Council decisions or sanctions packages; the picture is carried forward. As of 30 Oct: Eunews (page of 30 Oct, headlines only) reports that Italy and Spain settled their dispute on 22 Oct, ended their mutual border controls and restored Schengen, and that Parliament rejected one billion euros of cuts to the 2027 budget on 21 Oct; the page carried nothing on the release of the EUR 4.2 billion for Hungary, on a sanctions package or on enlargement. The picture is carried forward. As of 31 Oct: Eunews (homepage of 31 Oct, headlines only) reports that the Commission proposed a loan of EUR 45bn for Ukraine for 2027 on 30 Oct; the page carries no new report on the release of EUR 4.2bn for Hungary, sanctions or enlargement. The situation is carried forward. Status 1 Nov: The search found no new Council decisions or vetoes since the previous day (the Council page was not reachable, HTTP 403); the situation is carried forward. As of 02.11.: This run found no new evidence that changes the position of 01.11.; search hits mostly predated the reporting day, so the picture is carried forward. As of 03.11.: No new evidence in this round; the status of 02.11. carries forward (not re-checked: Council decisions, Eurostat releases, parliamentary deliberations).

SUBSTANTIATEDOn 13 Oct 2026 the EU opened negotiating Clusters 2 (internal market) and 3 (competitiveness and inclusive growth) for Ukraine and, the same day, for Moldova, and set closing benchmarks; the opening required unanimity, and no veto is mentioned in any of the sources. The step follows the accession conferences of 14 July (Montenegro, Albania, Ukraine, Moldova) and shows that enlargement is again producing decisions in the Council. Eurotrack entry: EU hält Beitrittskonferenzen mit vier Kandidatenländern ab SUBSTANTIATEDOn the opening of Cluster 3 for Serbia, EU ambassadors reached no unanimity on 8 July 2026: according to an EU diplomat, eight member states (Netherlands, Sweden, Finland, Belgium, Estonia, Lithuania, Bulgaria, Croatia) were against, because of the rule of law in Serbia and its lack of alignment with the Russia sanctions, although the Commission recommended the opening. Eurotrack also lists North Macedonia as blocked (no new EU negotiating step since July 2022, constitutional amendment pending) and Georgia as de facto halted; no later Council decision on Serbia was found. Earlier reports (Eunews, 15 Oct) described widely differing positions and the possibility of an agreement only in 2027. There is no formal veto; the decision requires unanimity and the consent of the European Parliament; the outcome text of the 15/16 Oct summit was not opened. A further EUR 2.2bn (academic freedom), EUR 0.5bn (child protection law), EUR 31m (asylum) and EUR 0.8bn (social inclusion) remain frozen; in total EUR 17.31bn could be released. The source says nothing on the state of the Article 7 procedure. Addendum 27 Oct: according to Xinhua (14 Oct), relaying an announcement by Hungary's EU delegation, the Council ended the conditionality procedure against Hungary on 13 Oct and thereby released the EUR 4.2bn; the vote split is not given, and no second independent source or Council document was opened. According to EUobserver the Council has one month to confirm the proposal; a Council decision is still not evidenced in the opened sources (as of 29 Oct). A more recent procedural step (rule-of-law report of 17 July 2026 with seven recommendations according to a TASR search excerpt) was not opened. - The restoration of the rule of law in Hungary (Commission proposal of 23 Sept) relieves one of the earlier blocking actors; whether the safeguards would survive another change of government is open (Euronews, 23 Sept 2026).

State
Δ SINCE LAST RUNNo confirmed front gains on 1/2 Nov (ISW); sabotage warning in Poland and a false nuclear alert in Ukraine are new, with no change to the tipping thresholds.
The front moves little according to ISW (30 Oct): Ukraine advanced south of Oleksandrivka and west of Kostiantynivka, Russia west and northwest of Huliaipole and, according to a Ukrainian observer (Mashovets), also east of Orikhiv; there were no confirmed Russian gains near Lyman, Sloviansk, Dobropillia, Kharkiv or Sumy. The Kremlin keeps rejecting front-wide ceasefires (Peskov on 29 Oct: Moscow wants a full settlement); a local ceasefire in occupied Oleshky has held for about 80 hours, and a Ukrainian delegation arrived there on 30 Oct. Ukraine hit the Novokuibyshevsk refinery (787 km from the border) on 30 Oct, and Russia attacked overnight to 30 Oct with missiles and 113 drones, mainly on Kyiv, Poltava and Dnipropetrovsk. In the Black Sea, three unmanned surface vessels, possibly Russian, hit the container ship Constship Jet about 21 nautical miles southeast of Shabla (Bulgaria) on 28 Oct; earlier attacks occurred in and near Romanian waters (13, 14 and 23 Oct) and in Bulgaria's economic zone (5 and 12/13 Oct). Hybrid: the Wall Street Journal reports, citing unnamed sources, an ordered escalation of Russian sabotage against NATO states, and the Danish service PET has seen sabotage against Danish suppliers to Ukraine since 8 Oct. Not reached: figures on military spending and NIS2 reports, and new dated cyber and ransomware assessments for October (the search returned only old items). Status 1 Nov: According to ISW (31 Oct), the local ceasefire in Kherson region (since 27 Oct) is mostly being observed, with both sides accusing each other of violations; the Kremlin holds to its maximalist demands and again demands that NATO withdraw to its 1997 borders. Russia launched 134 drones overnight into 31 Oct and 168 during the day, hitting among others a combined heat and power plant in Kyiv and substations, leaving hundreds of thousands of households without power. The US State Department approved a possible sale of 500 PAC-3 interceptors to Ukraine, with delivery according to ISW only in several years. As of 02.11.: No new primary pages were opened (ISW not reachable via search, fetch returned 403); search hits without an opened page cite Ukrainian claims of record Russian losses in October (a party to the conflict, unconfirmed) and preparation of a three-way meeting in the first half of November. The picture is carried forward. As of 03.11.: ISW (02.11.) reports no confirmed gains by either side on 1 and 2 Nov and a negative Russian net territorial gain over the past two months; Ukrainian counterattacks south of Lyman and southeast of Sloviansk. A Russian strike on Komyshuvakha near Zaporizhzhia reportedly killed at least 18 civilians (Ukrainian account). On 2 Nov Poland deployed additional security personnel after intelligence warnings of sabotage and armed border crossings; a cyberattack on Ukraine's air-alert app triggered a false nuclear warning on 1 Nov. Negotiations are not covered in the source.

PLAUSIBLEAccording to ISW (31 Oct), Ukraine advanced north-east of Borova; at Lyman, Sloviansk, Oleksandrivka, Hulyaipole and south-east of Orikhiv Russia attacked without a confirmed advance, with Ukrainian counterattacks at Lyman; a Ukrainian spokesperson acknowledged Russian advances along the border at Hraniv north of Kharkiv. The Kremlin continues to reject ceasefires; the US State Department approved a possible sale of 500 PAC-3 interceptors, with delivery only in several years. Before that, on 23 Oct a drone hit the freighter 'Khoryv' about 13 nautical miles off Constanta, just outside Romanian territorial waters; Romania's President Dan blamed Russia, Commission President von der Leyen spoke of a further Russian escalation. ISW counts attacks on ships in or near Romanian waters on 13, 14 and 23 Oct and in Bulgaria's economic zone on 5 and 12/13 Oct; responsibility is not officially confirmed, and fatalities are not evidenced in these incidents. The core statements rest on unnamed sources and are not independently confirmed; Moscow denies. Officially only the German attribution of the Leipzig incident to Russia of 1 Sept exists. In addition: according to United24 (21 Oct), Western services see the Leipzig incident (5 Aug) as a possible test; Serbian prosecutors reported seven arrests in a network that allegedly smuggled drones and explosives via Serbia to Germany (evidenced only via United24, itself based on the WSJ report and prosecutor statements). - The front collapses nowhere: according to ISW (28 Oct) there are only limited Russian advances (north of Kostyantynivka) and Ukrainian gains (south-east of Oleksandrivka, north-east of Hulyaipole); a sector collapse of more than 50 km is not discernible.
- Humanitarian channels function: prisoner exchange on 23 Oct and an announced local ceasefire in Oleshky; Putin shows willingness to talk after guarantees on the European security architecture are clarified (ISW).
- The freighter attacks in the Black Sea (most recently on 28 Oct, about 21 nautical miles off Bulgaria) hit civilian ships with no evidenced fatalities in the latest incidents and without a request for assistance; the sabotage campaign is so far evidenced only through unnamed sources (ISW; Meduza).

The Nexperia dispute remains unresolved at the last evidenced point (February, Wingtech appeal to the Supreme Court), and the current supply position is not evidenced. As of 31 Oct: this run found no new evidence on the EU package, national supply or the army budget (the Curia Vista page returned no content); the next APK-N meeting is scheduled for 5/6 Nov. The situation is carried forward. Status 1 Nov: The press release of the APK-N (meeting of 21 Oct) confirms the decisions and the schedule (5/6 Nov extraordinary, 16 to 18 Nov conclusion); there is no new evidence.
Findings 6
SUBSTANTIATEDAccording to AWP (21.10.2026) the APK-N voted 15 to 9 with one abstention to proceed to the stabilisation part of the EU package, left wage protection without a difference to the Council of States and approved the cohesion contribution act with commitment credits of about CHF 3.5bn to 2036 by 15 to 9, as well as its own state-aid commission (referral back rejected 15 to 10). Immigration including a levy of at least CHF 2,000 per adult family member on activating the safeguard clause, and the referendum mode, are postponed to 05/06.11., conclusion mid-November, debate in the National Council in the winter session. On the mode, the SPK-N demanded popular and cantonal majority according to SRF (22.05.), while the Federal Council wants the simple popular majority. The figures come from an agency report; the APK-N press release was not reached. According to the APK-N press release no decisions have yet been taken on the referendum question and on free movement of persons; the committee intends to conclude its work at the meetings of 5/6 Nov (extraordinary) and 16 to 18 Nov. It entered into the army financing by VAT (26.051 s) and rejected two referral motions by 17 to 8; it continues on 27.10. and prepares the report for the SiK-N. According to SRF (10.10.) salary, pension and address data may be affected; the scope and number of insured persons are unknown, and it is open whether data actually left. The supplier's account that the leak came from its own IT and not from client systems cuts the causal chain at the supplier; still open are why and by what route live data was held there, whether test or maintenance data were pseudonymised and whether Publica used its contractual audit rights, that is, the links within Publica's own reach. The reason is low water on the Rhine and Danube, which slows imports; goods are available on the world market, transport capacity is lacking. The event is also a link to the energy and climate topic (inland shipping, water levels). (cash.ch (31.08.2026), Meldung der wirtschaftlichen Landesversorgung)cash.ch ↗ SUBSTANTIATEDArmy: the 2026 army count (reference date 01.03.) shows 147,017 members against a target strength of 100,000; by 2030 the strength falls below 130,000, mainly because the last cohorts with twelve years of service obligation are discharged in 2028/2029, plus about 12,000 departures a year, mostly to civilian service (Federal Council, 06.10.). On 24.06. the Federal Council set expenditure of CHF 93.8bn for the 2027 budget (plus 3 per cent, army as the main driver); the army is to grow from just under CHF 7bn in 2027 to over CHF 10bn in 2032, further needs are to be financed by a VAT increase (popular vote planned for 2027). - The compulsory-stock release concerns only feed (at most 20 per cent of stocks), goods are available on the world market and transport capacity is lacking; no shortage of consumer or energy products was found (cash.ch, 31.08.2026).
- Even after the expected decline to 2030 the army strength stays above the target of 100,000, and army spending grows under the Federal Council plan from just under to over CHF 10bn by 2032 (Federal Council, 06.10. and 24.06.2026).
- The EU package received 31 to 11 in the Council of States and 15 to 9 in the APK-N; a popular vote is expected 2027 at the earliest, and a survey commissioned by economiesuisse (June, own interest) shows majorities for the bilateral path (AWP/cash.ch; economiesuisse).

Open conflicts between the executive and courts and election authorities are evidenced (Justice Department suits against election authorities, legal dispute over the order on mail voting); lasting disregard of a ruling or a troop deployment against the will of a state is not evidenced. Only the Supreme Court situation up to 28 Oct was re-checked; the rest of the picture is carried forward.
Since the last run: Correction of an indicator status (not_triggered to lapsed) based on events of 2025, no new development since the previous snapshot.
Relevance for Europe: The dispute over election rules before the midterms on 3 November and the executive's handling of the courts determine how reliable the US is as a partner on trade, NATO commitments and support for Ukraine, although this run evidences no immediate lever.

Δ SINCE LAST RUNTipping indicator 'Federal deployment ... against the declared will' corrected from not_triggered to lapsed: met in 2025 in California, Oregon and Illinois, withdrawn after the Supreme Court decision of 23.12.2025.
Carried forward from 26 October: this run only checked whether SCOTUSblog reports new rulings; its front page shows, after 22 October, only one item dated 26 October ("Trump-related cases coming to the court", headline only read) and no new ruling. The court picture runs to 23 October. On 21 October, in Trump v. Kingdom, the Supreme Court refused to stay an order on the prison policy for transgender inmates, and on 22 October it allowed New Hampshire to restrict student IDs for voting (Purcell principle). On 21 October the administration asked to continue border wall construction in the Big Bend region; responses are due by 29 October. In the dispute over the order on mail voting, the court on 24 August allowed the administration, 6 to 3, to proceed on the ground that the states had sued too early; a separate order by Judge Talwani against implementation at the Postal Service continues according to the report opened. The pattern remains ruling, appeal and emergency application. Not re-checked: National Guard deployments and action against election officials (last to 10 October), election authority findings of 9 and 15 October. The planned deployment of about 1,000 Justice Department monitors at polling places (NAACP records suit, no ruling evidenced) is carried forward. As of 29 Oct: SCOTUSblog reports on 27 Oct that the Court declined to restore a Biden-era rule suspending deportation proceedings, and on 28 Oct that it will not disturb the agreement between Texas and the Justice Department on deportation proceedings (headlines only read); the overview names no outcome for the border wall application of 21 Oct, and posts on National Guard deployments are absent. Election day remains 3 Nov. As of 30 Oct: SCOTUSblog (home page, 29 Oct) records that groups asked the Court to leave in place a lower court order halting border wall construction in southwestern Texas (response to the government's application of 21 Oct; headline only); no other new rulings. The pattern remains ruling, appeal and emergency application. As of 31 Oct: SCOTUSblog (homepage of 31 Oct) records no rulings or emergency orders from 28 to 31 Oct; the application of 21 Oct on border wall construction in the Big Bend region is still pending, the November session begins on 2 Nov, and election day remains 3 Nov. The situation is carried forward. Status 1 Nov: SCOTUSblog (front page, posts up to 30 Oct) records no new ruling in government cases; on 27 Oct the court declined to restore a Biden-era rule on suspending deportation proceedings, and on 29 Oct groups asked the court to leave in place the order halting border wall construction in southern Texas (a request, not a ruling). As of 02.11.: This run found no new evidence that changes the position of 01.11.; search hits mostly predated the reporting day, so the picture is carried forward. As of 03.11.: SCOTUSblog reports for 02.11. (Amy Howe) that the Supreme Court declined the administration's request to intervene in a California ballot dispute (only headline and summary read). The page lists no executive orders or National Guard deployments for 30.10. to 03.11. Correction 03.11.: The tipping indicator on federal deployment against a state's will was met in 2025 (California, Oregon, Illinois) and has lapsed since the withdrawal after Trump v. Illinois (23.12.2025); it is now carried as lapsed, the situation stays strained.
Findings 8
SUBSTANTIATEDOn 21 October 2026, in Trump v. Kingdom (26A416), the Supreme Court refused the administration's application to stay an order by Judge Royce Lamberth that prevents the Bureau of Prisons from implementing its policy on transgender inmates; unsigned order without reasons, Thomas and Alito would have granted the application. (SCOTUSblog (Amy Howe, 21.10.2026))scotusblog.com ↗ · scotusblog.com ↗ SUBSTANTIATEDOn 21 Oct 2026 the government applied (Mullin v. Friends of the Ruidoso Church) to continue border wall construction in the Big Bend region of Texas; on 29 Oct the opponents asked the Supreme Court, according to SCOTUSblog, to leave in place the lower court order halting construction (headline of the response only). (SCOTUSblog, 29.10.2026)scotusblog.com ↗ SUBSTANTIATEDOn 22 October 2026 the Supreme Court allowed New Hampshire to enforce a law that excludes student IDs as voter photo ID (unsigned order citing the Purcell principle, Justice Jackson dissenting). Three cities and a legal aid organisation also applied to stay an agreement between Texas and the Justice Department on deportation proceedings; Texas and the DOJ responded on 22 October, and a ruling is pending. Further emergency rulings: on 27 Oct the Court declined to restore a Biden-era rule suspending deportation proceedings, on 28 Oct it left in place the agreement between Texas and the Justice Department on deportation proceedings (only headlines of the overview read). (SCOTUSblog (Amy Howe u. a., 22./23.10.2026))scotusblog.com ↗ · scotusblog.com ↗ · scotusblog.com ↗ SUBSTANTIATEDOn 24 August 2026 the Supreme Court allowed the administration, by 6 to 3, to implement parts of the President's order on mail voting (including voter lists via the Homeland Security Department) because the plaintiff states had sued too early; the court did not rule on lawfulness. A separate order by Judge Indira Talwani against implementation at the Postal Service continues according to the report, and the DOJ is likely to argue that the ruling extends to it. Sotomayor and Kagan led the dissent. (CBS News (24.08.2026))cbsnews.com ↗ PLAUSIBLECarried forward, not reopened in this round and therefore without a link: federal judge Sparkle Sooknanan (D.D.C.) declared the nationwide DOJ programme to query voter rolls unlawful on 9 October; the DOJ is reviewing the ruling. On 15 October the DOJ sued California's chief election authority and that of Los Angeles County over allegedly more than 20,000 votes by non-citizens (an allegation by the suing executive, not independently confirmed). The sources were not reachable again. (Al Jazeera (09.10.2026); Political Wire unter Berufung auf Washington Post (15.10.2026), im Vorsnapshot gelesen)
SUBSTANTIATEDAccording to Democracy Docket (5 October 2026) the Justice Department plans about 1,000 federal staff at polling places (the largest deployment of its kind according to division head Dhillon; about 289 in 2022, about 714 in 2024); the NAACP sued over delayed release of records under the freedom of information law, the suit does not aim to stop the deployment, and no ruling is mentioned in the report. Hennepin County refused monitors indoors. Assessment: monitors are not a deployment of armed forces; the source is a partisan legal portal and relays statements by the ministry and the plaintiff. (Democracy Docket (05.10.2026))democracydocket.com ↗ PLAUSIBLEAccording to the SCOTUSblog front page, on 02.11.2026 the Supreme Court declined the Trump administration's request to intervene in a California ballot dispute; only the headline and summary were read, details are missing. (SCOTUSblog (Amy Howe, 02.11.2026))scotusblog.com ↗ SUBSTANTIATEDOn 23.12.2025 the Supreme Court in Trump v. Illinois denied, 6 to 3, the administration's application to stay the injunction against federalising the Illinois National Guard; the majority held the President likely lacked authority under 10 U.S.C. 12406(3). The administration had invoked the provision in 2025 in California, Oregon and Illinois against the governors' will and afterwards announced the withdrawal from Chicago, Los Angeles and Portland 'for the time being'. Emergency-docket decision, not a merits ruling; deployments at governors' request (Louisiana, Tennessee) do not fall under the threshold. Counter-indicators 3
- The administration pursues defeats through appeals and emergency applications rather than ignoring them; the border wall application of 21 October is a further example (SCOTUSblog).
- The Supreme Court does not automatically grant the administration's emergency applications; in Kingdom the application was refused on 21 October (SCOTUSblog).
- The rulings on mail voting and New Hampshire rest on jurisdiction and the Purcell principle, not on an endorsement of the executive's measures on the merits; the courts remain seized (CBS News; SCOTUSblog).
